Lillig & Thorsness, Ltd. Obtains Summary Judgment In Favor Of Property Preservation Company

Lillig & Thorsness, Ltd. attorney Angela Iaria successfully obtained a summary judgment ruling in favor of an L&T client in the Circuit Court of Cook County.

The Plaintiff alleged that she fell into an open manhole cover and suffered significant injuries on a property that was being maintained by L&T’s client, a property preservation company. L&T denied that its client had a duty to maintain the property or warn the Plaintiff of any dangerous conditions on the property because, although the property was in foreclosure proceedings, it was still occupied by the mortgagor. The court rejected the Plaintiff’s argument that by conducting periodic occupancy inspections, L&T’s client possessed and controlled the property and therefore owed Plaintiff a duty of care.
