Lillig & Thorsness, Ltd. Obtains TRO To Stop Former Trustee From Acting On Behalf Of Trust

Lillig & Thorsness, Ltd. attorneys Adrian Mendoza and Edward R. Sherman obtained a temporary restraining order in DuPage County, Illinois on behalf of a corporate trustee in order to stop a former trustee from continuing to act on behalf of the trust.

The trust’s beneficiaries had removed the former trustee “for cause” but he refused to acknowledge the removal and continued to conduct business as trustee, including transferring trust property to himself and others, filing legal actions on behalf of the trust, interfering with the Trust’s contractual relationships and threatening to disinherit certain beneficiaries who opposed his conduct. Attorneys Mendoza and Sherman were able to demonstrate that the trust had legally protectable interests and would suffer irreparable injury in the absence of a TRO enjoining the former trustee from acting.
